1. Agreement to Terms
By accessing or using FrontDeskOS ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
2. Description of Service
FrontDeskOS provides a smart front desk service that:
- Answers phone calls 24/7 using intelligent automation
- Schedules appointments and manages calendars
- Captures and tracks leads
- Provides call recordings, transcripts, and analytics
- Offers a dashboard for managing your business communications
3. Account Registration
To use FrontDeskOS, you must:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your password and account
- Be at least 18 years old or the age of majority in your jurisdiction
- Notify us immediately of any unauthorized access to your account
You are responsible for all activities that occur under your account.
4. Subscription and Billing
4.1 Free Trial
We offer a 14-day free trial with no credit card required. The trial includes full access to all features during the trial period.
4.2 Paid Subscriptions
After your trial ends, you must subscribe to continue using the Service:
- Subscriptions are billed monthly at $499/month ($16/day)
- Billing occurs automatically on your subscription renewal date
- You authorize us to charge your payment method for all fees
- All fees are non-refundable except as required by law
4.3 Changes to Pricing
We reserve the right to modify our pricing. We will provide at least 30 days' notice before any price changes take effect. Your continued use of the Service after the price change constitutes acceptance of the new pricing.
4.4 Cancellation
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until the end of the paid period.
5. Acceptable Use
You agree not to:
- Use the Service for any illegal or unauthorized purpose
- Violate any laws or regulations in your jurisdiction
- Infringe on intellectual property rights of others
- Transmit harmful code, viruses, or malicious software
- Attempt to gain unauthorized access to our systems or networks
- Use the Service to send spam, unsolicited communications, or harassment
- Impersonate others or provide false information
- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble any part of the Service
6. Call Recording and Compliance
You acknowledge and agree that:
- FrontDeskOS may record calls for quality assurance, training, and service improvement
- You are responsible for complying with all applicable call recording laws in your jurisdiction
- Some jurisdictions require consent from all parties before recording calls
- You must inform callers that calls may be recorded if required by law
- You indemnify us against any claims arising from your failure to comply with recording laws
7. Intellectual Property
7.1 Our Rights
The Service, including all content, features, and functionality, is owned by FrontDeskOS and is protected by copyright, trademark, and other intellectual property laws.
7.2 Your Data
You retain all rights to the data you input into the Service. By using the Service, you grant us a license to use, store, and process your data solely to provide and improve the Service. If you opt into Smart Learning, you grant us the right to use anonymized, aggregated data as described in our Privacy Policy.
8. Service Availability and Support
While we strive for 99.9% uptime:
- We do not guarantee uninterrupted or error-free service
- We may perform scheduled maintenance with prior notice
- We may suspend or terminate the Service for violations of these Terms
- Customer support is provided via email during business hours
9. Privacy and Data Protection
Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
- Merchantability and fitness for a particular purpose
- Non-infringement of third-party rights
- Accuracy, reliability, or completeness of information
- That the Service will meet your requirements
- That the Service will be uninterrupted, secure, or error-free
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
- Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for any loss of profits, revenue, data, or business opportunities
- These limitations apply even if we have been advised of the possibility of such damages
12. Indemnification
You agree to indemnify, defend, and hold harmless FrontDeskOS, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your violation of applicable laws or regulations
13. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for:
- Violation of these Terms
- Non-payment of fees
- Fraudulent or illegal activity
- Extended periods of inactivity
Upon termination, your right to use the Service will cease immediately. We may delete your data after a reasonable retention period, subject to legal requirements.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of material changes by:
- Posting the updated Terms on this page
- Updating the "Last updated" date
- Sending an email notification to your registered email address
Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which FrontDeskOS is registered, without regard to conflict of law principles.
Any disputes arising from these Terms or the Service shall be resolved through binding arbitration, except that either party may seek injunctive relief in court for violations of intellectual property rights.
16. Miscellaneous
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FrontDeskOS regarding the Service.
16.2 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
16.3 Waiver
Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
16.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign these Terms without restriction.
